As we know that India follow bicameral (Upper house and Lower house) system both at centre and state level.Under this system, Indian state legislature is divided into two part and houses are:-


1. Legislative Assembly.(Vidhan Sabha) and 

2. Legislative Council.(Vidhan Parisad).

Constitution of India has not mandated the state to former Legislative Council.

As we know that the state legislative assembly is held after every 5 years. So that Administrativestructure is get formmed in the state encourage the development for the next five years under any particular party.To make government in any state of India a party should have a majority of constituency in that state.


Today in this article, I will tell you about the major difference between MLA and MLC in the state of India in any state of India. Before starting this article you must have some basic knowledge of election.


Election Commission of India is only statutory body responsible for the conducting election in India.It supervise and conduct the election for every constituency formed in India.

    What is MLA ?

    The full form of MLA is the "Member of Legislative Assembly".MLA of difference constituency is elected by the general public for the reign of 5 years. There are a lot of MLA in any state and the number varies from state to state.Its mean from each constituency,People can elect one representative,who became a member of legislative assembly in the state.


    Eligibility criteria for MLA election:-

    1. Candidate should be a India citizen.
    2. Candidate's age should be more than twenty-one years.
    3. Candidates should not allow to hold any other government post (beaurocrats or officials).

    Along with these three main criteria, there are many mandatory criteria for member of legislative assembly.

    What is MLC ?

    The full form of MLC is "Member of Legislative Council". They are the representatives of legilatice council in a particular state of India.As I already said that it is not mandated to form legislative council in a state. Due to this there is only Six state that form on Legislative Council.

    Eligiblity criteria for mlc is almost same as eligibility criteria of mla.


    Till January 2020, there is only Six Legislative Council of a state in India. They all are:- 


    1. Andhra Pradesh Legislative Council

    2. Karnataka Legislative Council

    3. Maharashtra Legislative Council

    4. Telangana Legislative Council 

    5. Uttar Pradesh Legislative Council

    6. Bihar Legislative Council

    Election Process for MLC:-

    Election process for MLC is quite different from the election of MLA. In Legislative Council,

    - 1/12th of MLC is elected by graduate ,

    -1/12th of MLC is elected by teachers,

    -1/6th of MLC is nominated by the Governor of the state and

     remaining all are elected by the MLA through Single Transferable Vote(Paper Ballet).

    The constitution of India give Limited power to the Legislative Council as compared to the legislative assembly. And according to the Article 169 of Indian constitution,Parliament and State legislative assembly has a power that they can easily abolish the Legislative Council by passing effective resolution through the special majority.

    For Example:- In 1985, Parliament has abolished the Legislative Council of Andhra Pradesh,but later it was reinstated.

    Difference between MLA and MLC ?

    There are some basic difference between mla and mlc are given shortlly in box:-

    MLA("Member of Legislative Assembly") :-

    1. It is the member of legislative assembly.

    2. Elected by the general public.
    3. Reign duration is Five Year.
    4. Sit in Vidhan Sabha.
    5. MLC cannot become MLA in reign period.

    MLC("Member of Legislative Council") :-

    1. It is the member of legislative council.
    2. Elected  and nominated by the different government officials and graduates.
    3. Reign for six year, but 1/3 of them  retiring every year.
    4. Sit in Vidhan Parisad.
    5. MLA can also become a MLC.


    At last you need to know that Legislative council is a unnecessary and an unrepresentative of the people of that state and it considered as a burden on the state budget and also cause a huge delay in legislation. It has been always criticised by various politician and representative of India.
